TERMS & CONDITIONS OF SERVICE

Commercial Trailer Services LTD – Trailer Manufacturing & Repair (Canada)

1. Agreement

This Terms & Conditions Agreement (“Agreement”) governs all services provided by Commercial Trailer Services LTD (“Company”) to the customer (“Client”) within Canada. By requesting or authorizing services, the Client agrees to be bound by this Agreement.

2. Services

The Company provides:

  • Custom trailer manufacturing and fabrication
  • Trailer repair, maintenance, and inspection
  • Parts installation, upgrades, and modifications

All services will be performed in accordance with generally accepted industry standards in Canada.

3. Quotations & Estimates

  • All estimates are valid for 30 days unless otherwise stated
  • Estimates are based on initial inspection and may change if additional issues are discovered
  • Any additional work requires Client approval

4. Pricing & Taxes

  • All prices are in Canadian Dollars (CAD)
  • Applicable taxes (e.g., Goods and Services Tax (GST) / HST / PST) will be added as required by law
  • Material cost increases or custom modifications may affect final pricing

5. Payment Terms

  • A deposit of 30%–50% is required for custom builds
  • Full payment is required prior to release or delivery
  • Invoices are due within 30 days unless otherwise agreed
  • Overdue accounts may be subject to interest (e.g., 1.5% per month)

6. Warranty

New Trailer Builds

Covered by a limited warranty of 6–12 months on workmanship.

Repairs

Warranty applies only to parts replaced and labour performed.

Exclusions

Warranty does not cover: Normal wear and tear, overloading or misuse, accidents or road damage, unauthorized alterations.

7. Compliance with Canadian Laws

All trailers will be built or repaired to comply with applicable Canadian standards, including:

  • Transport Canada regulations
  • Motor Vehicle Safety Act
  • Provincial vehicle and road safety laws

The Client is responsible for ensuring proper registration and licensing.

8. Inspections & Acceptance

  • The Client must inspect the trailer upon completion
  • Any defects must be reported within 48 hours of delivery
  • Failure to report constitutes acceptance of the Work

9. Repairs & Additional Work

If additional issues are identified during repair, work will pause until Client approval is obtained. Additional charges may apply.

10. Limitation of Liability

  • The Company is not liable for indirect or consequential damages, including loss of income or cargo
  • Total liability shall not exceed the amount paid for the services

11. Indemnification

The Client agrees to indemnify and hold harmless the Company from any claims arising from improper use of the trailer, violation of safety regulations, or modifications made after service.

12. Storage & Abandoned Property

  • Trailers must be collected within 14 days of completion notice
  • Storage fees may apply thereafter
  • Uncollected trailers may be treated as abandoned property in accordance with provincial law

13. Cancellation Policy

Deposits are non-refundable once work has commenced. Cancellations prior to work may incur administrative charges.

14. Force Majeure

The Company shall not be liable for delays due to supply chain disruptions, weather conditions, labour shortages, or other events beyond reasonable control.

15. Dispute Resolution

Disputes shall be resolved through good-faith negotiation, mediation within British Columbia, or court proceedings if necessary.

16. Governing Law

This Agreement shall be governed by the laws of the Province of British Columbia and the laws of Canada applicable therein.
